Virginia Code § 18.2-266 sets a blood alcohol content (BAC) threshold of 0.08% for standard adult drivers. Three convictions within 10 years may carry a mandatory minimum of 90 days. An ignition interlock device may be required as a condition of any restricted driving privileges at any offense level.

Under Virginia’s implied consent law, refusing a breath or blood test after a lawful arrest may result in an automatic one-year license revocation for a first refusal.
