Virginia Drug Possession Laws & Penalties

Virginia classifies controlled substances across six schedules based on medical use and abuse potential. Schedule I substances, including heroin, LSD, and ecstasy, have no accepted medical use and carry the highest abuse potential. Possession of a Schedule I or II controlled substance, such as cocaine, methamphetamine, or PCP, is a Class 5 felony under Virginia Code § 18.2-250, carrying up to 10 years in prison and a fine of up to $2,500.

Not all possession charges are felonies. Adults 21 and older may lawfully possess small amounts of marijuana under Virginia law, so simple possession within the legal limit isn’t a criminal offense, though exceeding that amount or other circumstances can still result in a civil penalty or criminal charges. Possession of drug paraphernalia is a Class 1 misdemeanor with penalties up to 12 months in jail and a $2,500 fine. Sentencing in any case can turn on criminal history, the circumstances of the arrest, and cooperation with authorities.

From Arrest to Arraignment in Alexandria
